1. CONTROLLER OF PROCESSING

 

DLP S.A.S. (DLP Arquitectura y Diseño), identified with NIT 800.057.273-1, domiciled in the city of Barranquilla, Colombia, acts as the controller and/or processor of personal data collected or provided within the scope of its commercial, contractual and professional activities.

In view of the above, DLP S.A.S. adopts this Privacy Policy in compliance with Law 1581 of 2012, Decree 1377 of 2013, Single Regulatory Decree 1074 of 2015, the guidelines of the Superintendence of Industry and Commerce (SIC), and, where applicable, with international data protection standards such as the European Union’s General Data Protection Regulation (GDPR).

 

2. CATEGORIES OF PERSONAL DATA PROCESSED

 

2.1. Public Data

DLP S.A.S. may process publicly available data without prior authorization of the data subject, in accordance with legal provisions, for example data contained in public registers, directories, official documents or judicial decisions. Nevertheless, the principles and legal obligations in force will be guaranteed.

 

2.2. Private and Sensitive Data

DLP S.A.S. processes private personal data and, exceptionally, sensitive data, only when strictly necessary for the fulfilment of its corporate purpose: provision of architecture services, interior design, 3D modeling, rendering, BIM consultancy, preparation of drawings, technical construction documents and other related services.

 

Processing of sensitive data will only be performed when:

  • There is express and prior authorization of the data subject.

  • It is necessary to safeguard the vital interest of the data subject who is physically or legally incapacitated.

  • It is required for the recognition, exercise or defense of a right in judicial proceedings.

  • It serves statistical, historic or scientific purposes, guaranteeing data dissociation.

 

Under no circumstances will service provision be conditioned on furnishing sensitive data, unless there is a legal or contractual cause to do so.

 

2.3. Data of Minors

Processing of data of children and adolescents will only occur when strictly necessary and always respecting their best interests and fundamental rights, in accordance with Article 7 of Colombian Law 1581 of 2012.

 

Authorization must come from their legal representatives, ensuring that the minor has been heard and informed about the use of their data.

 

3. RIGHTS OF THE DATA SUBJECTS

 

In accordance with applicable regulations, data subjects have the following rights:

  • To access, know, update and rectify their personal data held by DLP S.A.S.

  • To request proof of the authorization granted for data processing, except in cases exempted by law.

  • To be informed about the usage made of their personal data.

  • To file complaints with the Superintendence of Industry and Commerce (SIC) for breaches of personal data protection regulations.

  • To revoke the authorization and/or request deletion of data, unless a legal or contractual obligation prevents it.

  • To obtain free access to the personal data under processing.

 

4. DUTIES OF DLP S.A.S. AS DATA CONTROLLER

 

DLP S.A.S. acknowledges that personal data belongs to its data subjects and commits to processing it only for the legitimate and authorized purposes.

 

Accordingly, it fulfils the duties established in Articles 17 and 18 of Law 1581 of 2012, including:

  • Guaranteeing the exercise of habeas data rights.

  • Requesting and preserving duly granted authorizations.

  • Informing about the purpose of processing and the rights of data subjects.

  • Keeping information under strict measures of security, confidentiality and integrity.

  • Maintaining data up to date, accurate and verifiable.

  • Rectifying or updating data where necessary.

  • Processing queries and complaints within legal timeframes.

  • Complying with instructions and requirements of the Superintendence of Industry and Commerce (SIC).

  • Duty of confidentiality.

 

All persons involved in processing personal data must maintain professional confidentiality even after their contractual relationship with DLP S.A.S. ends. Failure to comply will lead to legal and contractual penalties.

 

5. PURPOSE AND USE OF PERSONAL DATA

 

DLP S.A.S. will collect, store and use personal data for the following purposes:

  • To properly provide the contracted services of architecture, interior design, 3D modeling, rendering, technical consulting, among others.

  • To carry out quotation, contracting, execution and project monitoring processes.

  • To manage commercial, administrative, labour and contractual relationships.

  • To fulfil legal, accounting, tax and reporting obligations to competent authorities.

  • To manage requests, petitions, complaints, claims and satisfaction surveys.

  • To send commercial, technical and advertising information related to the services offered.

  • To share data with suppliers, partners or contractors, within or outside the country, when necessary for service provision or legal compliance.

  • To improve internal processes and user experience on the website and digital channels.

 

6. INTERNATIONAL DATA PROCESSING

 

DLP S.A.S. may transfer or transmit personal data to third parties located in other countries only when necessary for the fulfilment of its services and under the conditions established by law.

When data are transferred to countries without an adequate level of protection, contractual, technical and organizational measures will be implemented to ensure confidentiality, security and compliance with international data protection principles in alignment with the GDPR.

 

7. PROCEDURE TO EXERCISE RIGHTS

 

Data subjects may exercise their rights of access, rectification, updating, deletion or revocation by means of a written request addressed to:

The request must include:

  • Full name and identification of the data subject

  • Clear description of the reason or request

  • Evidence or documents supporting the petition

 

Response timeframes:

Queries: Data subjects may request access to personal data stored in any DLP S.A.S. database. Authentication measures will be applied to verify identity. Requests will be processed within ten (10) business days from receipt. If not feasible within the term, DLP S.A.S. will inform the data subject before the term expires and will resolve the request within an additional five (5) business days.

Claims: The data subject may submit a request for correction, updating or deletion, or raise a presumption of breach of duties and principles under Colombian Law 1581 of 2012. These requests will be resolved within fifteen (15) business days, extendable by eight (8) additional business days with justification. If the request is incomplete or erroneous, DLP will notify the subject within five (5) business days to rectify; if after two (2) months the subject does not respond, the request is deemed withdrawn. If the request falls outside DLP’s competence, it will be forwarded within two (2) business days and the subject informed. In case of disagreement with the response, the data subject may file a complaint with the Colombian Superintendence of Industry and Commerce (SIC) – Personal Data Protection Division.

 

8. INFORMATION PROCESSING

 

In cases of data other than public information (as defined in numeral 2 of Article 3 of Colombian Regulatory Decree 1377 of 2013), DLP S.A.S. will request prior authorization for personal data processing by any means that can serve as proof.

Such authorization may form part of a broader document, such as a contract, specific form, supplementary agreement, or at the moment of registration through any of DLP S.A.S.’s digital or physical platforms (logs).

DLP S.A.S. may collect the following information from its clients:

  • Full name (of natural or legal person)

  • Identification (natural or legal person and legal representative(s)), e.g.:

    • Citizenship ID (C.C.)

    • Foreign ID (C.E.)

    • Passport

    • NIT

    • Commercial Registry

    • Tax Registry (RUT)

    • Other (including visual copies of documents)

  • Residential address and mailing address

  • Contact phone number

  • Email address

  • Geolocation

  • Payment method information

 

Clients should note that information submitted in message-enabled spaces becomes known to DLP S.A.S., and they thereby authorize its use for service provision.

 

9. RETENTION AND SECURITY OF INFORMATION

 

DLP S.A.S. will retain personal data for the period necessary to fulfil the purposes for which they were collected or in accordance with legal retention periods.

It will implement reasonable technical, human and administrative measures to prevent alteration, loss, unauthorized consultation or access to information.

 

10. TERM AND UPDATES

 

This Privacy Policy enters into force on 12 February 2025 and will remain effective while DLP S.A.S. conducts its corporate purpose and continues processing personal data.

11. ACCEPTANCE OF THE POLICY

 

By providing their personal data by any means (web form, email, web or mobile app, telephone contact, videoconference, in-person visit or contractual engagement), the data subject expressly authorizes DLP S.A.S. to process their data in accordance with the purposes described herein.

The data subject declares that they understand that:

  • They may revoke the authorization or request deletion of their data at any time.

  • They have the right to access, update and rectify their information.

  • Answering questions about sensitive data or minors is optional.

  • They authorize the possible international transfer of their data under applicable legal parameters.
